In this on-again, off-again legal battle regarding ‘public charge’, we’re in the on-again state of affairs I’m afraid. Today, the federal court in the Second circuit lifted the nationwide injunction and allowed the injunction to remain only in New York, Connecticut and Vermont. If you do not live in one of those states, you must file an I-944 public charge form with your adjustment of status application.
We did rush to file some of our AOS cases last week when the injunction was in place. It is hard to know what the agency will do with those cases. Though, we filed with the injunction in place with USCIS website printouts included in the packet that there was an injunction, so hoping those cases will be accepted. We will keep you posted.
