December 2011 visa bulletin commentary

The long awaited December 2011 visa bulletin was finally released today. Here are our comments for our clients:

 

For all countries except India, China, Philippines and Mexico: F2A preference has advanced 36 days to Priority Date (PD) 22-Mar-2009; F2B category has advanced 14 days to PD 15-Aug-2003; F4 category advanced 31 days to PD 15-Jul-2000, EB2 remains current and EB3 advanced 25 days to PD 15-Jan-2006.

For India only: F2A category advances 36 days to priority date 22-Mar-2009; F2B advanced 14 days to PD 15-Aug-2003; F4 advanced 31 days to 15-Jul-2000; EB2 category advances 4 months and 15 days to 15-Mar-2008 and lastly EB3 advances 11 days to 11-Aug-2002.

This is the last visa bulletin of 2011.  We will be updating you with January 2012 visa bulletin news when it is available.

No retrogression is always good news.  Our regular readers will notice that we have added the F4 category to our commentary due to all the questions you ask us.  Thank you for your questions.  If you do have any specific questions about your own priority date, please feel free to let us know.

    Thank you for your question. Are you from Mexico or the Philippines? I am afraid I cannot predict what will happen with visas in your category. In the last 3-4 months, there has been slow movement forward so I would hope the trend will continue rather than retrogress.

  • Hello, thanks for your question. If you are from India or ‘all other countries’ – it seems you are likely to wait about a year before your visa is available. While 12 months may seem like a long time, in the world of visa-availability, it is actually a relative short wait. I would watch out for NVC processing your petition (if they haven’t already), as they do seem to be processing some petitions early so that they can be prepared when a visa is available. We have seen several such cases at our office. Good luck!

  • How about F1 for Rest of the World. Will it move soon back to Feb 2006 (the date before retrogression)? It is still stuck at 2004 🙁

  • Hi there, it seems that you are likely to wait about 1 year and 2 months, subject to any retrogression that may occur. Wish I could better predict this. I would suggest that you keep an eye on the bill pending called Fairness for High-Skilled Workers Act. This bill intends to reduce the time it takes for people like yourself to get green cards.   • Hello, thanks for your question. It seems that December 2010 is when things took a turn (in recent history) when the priority dates (PD) were in 2006. Jan-March 2011 we saw PDs move to 2005 and then in April they retrogressed to 2004. I am sure you have been monitoring these dates. It does seem like things will not move much further in the short term. However, I am never comfortable making such predictions because ultimately the Department of State will make announcements according to their calculations of visa availability. I would suggest you keep an eye on a bill currently pending in Congress called Fairness for High-Skilled Immigrant Workers Act. This bill intends to reduce waiting times for both family-based and employment-based immigrant petitions. Best of luck.

    Aw, that’s hard to hear. Why do you think so? After so many months of little to no forward movement, I was expecting a big jump on January’s VB for F1.

  • Hello, When do you think priority date of February 7,2006 EB3 Philippines become current? Is there any chance for this upcoming January 2012 visa bulletin.

  • Assuming you are not from Mexico or Philippines, it seems you have about a 3 years wait. For people from Mexico or Philippines, the wait is about 12 years. These timelines are subject to change of course.

  • It is always hard to make such predictions with accuracy I’m afraid. However, given that there has been an average of a 3 week advancement each month since September 2011’s visa bulletin, you have a chance of having your visa available next month. Of course, all depends on what the govt. will release in the next bulletin. Good luck!

  • Hello, my fiancé file k1 fiancé visa for me since March 2008, he received RFE on January 24th 2011 and he sumitted all what they requested for on the 25th of January 2011. Uptill today December 1st 2011 still not NAO2. Please can any one help me out bcz I’m feeling dying I want to be with my love, I’m getting older

  • I have a similar situation only i had my interview in June 2011 and was told like around October 01, I should receive my GC in the mail however due to retrogression. I am still waiting? what do you think? Thx
