On Monday August 12, 2019, DHS released the unpublished final rules making drastic changes to the ‘public charge’ will be considered for those applying for green card. I have not read the rule yet but will write more soon. Keep an eye on the news, this will be a big deal.
The rule will be officially published on August 14th and will be effective 60 days later. Cases that are pending before October 14th effective date will not be subject to this rule (therefore, this rule is not retroactive).
Adjustment of Status applicants will have to file a Form I-944- Declaration of Self-Sufficiency in addition to the usual application forms. Failure to file this form will result in a rejection or denial of the application without a request for it.
