June 2022 Visa Bulletin

The June 2022 Visa Bulletin was released. This month was the EB2 India movement continues, as the final action date advances 12 months. Otherwise, the dates remain the same as last month.

Commentary:

June 2022 

For all countries except India, China, Philippines, and Mexico: F1 category remains at December 1 2014; F2A category priority date remains current, F2B preference remains at a PD of 22 September 2015, F4 category remains at 22 March 2007; EB1 remains current; EB2 remains current; and EB3 remains current. 

 

For India only: F2A category remains current, F2B preference remains at 22 September 2015, F4 remains a PD of 15 September 2005; EB1 remains current; EB2 advances 365 days to 1 September 2014; EB3 remains at a PD of 15 January 2012; All EB5 visas are  current.

 

For China only: EB1 remains current; EB2 remains at a PD of 1 March 2019; EB3 remains at a PD of 22 March 2018; All EB5 Non-Regional Center are now current  except for the EB5 Unreserved (I5 and R5) China remains PD date of 22 November 2015. 

Vietnam is not individually listed and should use all countries category.

 

Can file your immigrant applications if PD before: 

 

F2A Current; F2B 22 September 2016 for All Areas, except Mexico remains 1 May 2001 and Philippines remains at 1 October 2013 ; F4 1 October 2007 for All Areas, except India remains at 22 February 2006, Mexico remains 01 March 2001, and Philippines remains 22 April 2004 .

 

EB1 Current for all countries, including China and India; EB2 All countries except India and China are current; EB3 Current for all countries except India and China; EB2 India 1 December 2014; EB3 India 22 January 2012; EB2 China 1 April 2019; EB3 China 1 April 2018; EB5 China (C5, T5, I5, R5 ) remains at 22 December 2015; All other EB5 China categories remain Current; Vietnam is not individually listed and should use the all countries category.

D.  ESTABLISHMENT OF EMPLOYMENT THIRD PREFERENCE “OTHER WORKERS” (EW) FINAL ACTION DATE

High number use in the Employment Third Preference “Other Workers” (EW) category has necessitated the establishment of a worldwide final action date in June to hold number use within the maximum allowed under the FY-2022 annual limit. All countries are subject to a final action date of 08MAY19 except for China-mainland born, which is subject to a 01JUN12 final action date and India, which is subject to a 15JAN12 final action date.

E.  ESTABLISHMENT OF C5 and T5 FINAL ACTION DATE AND APPLICATION FILING DATE FOR CHINA-MAINLAND BORN

It has become necessary to establish a final action date and application filing date for C5 and T5 China-mainland born because sufficient demand has materialized as readers were cautioned was a possibility in Item D of the May 2022 Visa Bulletin. China-mainland born C5 and T5 applicants are subject to a 22NOV15 final action date and an application filing date of 15DEC15.

F.  AVAILABILITY OF DIVERSITY VISAS (DV)

Most regions have been set to “Current” for June 2022 in an effort to maximize number use during the DV-2022 program year. However, rank cut-offs could be re-established for any region or country in future months to keep number use within the applicable annual limits.

G.  FAMILY-SPONSORED SECOND PREFERENCE VISA AVAILABILITY

Item D in the July 2019 Visa Bulletin advised that the F2A category was made current to increase the level of demand and encourage applicants to actively pursue final action on their cases. The item also advised that once large numbers of F2A applicants did begin to have their cases brought to final action, it would be necessary to establish a date to keep number use within the annual limit.

Number use in the F2A category has remained steady throughout FY-2022 and it may be necessary to establish an F2A final action date as early as August. This situation is being continually monitored and any necessary adjustments will be made accordingly.
