Alternative U.S. investor visa pathways for Indian nationals
EB-5 Immigrant Investor Visa
Open to all nationalities regardless of treaty status. Requires a qualifying investment of $800,000 (Targeted Employment Area) or $1,050,000 (standard). EB-5 leads directly to a U.S. green card — a significant advantage over E-2, which does not provide a path to permanent residence. Indian nationals face no EB-5 backlog (unlike EB-2 and EB-3, which have decades-long waits for Indian nationals).
O-1 Visa — Extraordinary Ability
For individuals with extraordinary ability in business, science, technology, the arts, or athletics. No investment required — the visa is based on documented achievement. The O-1 is a nonimmigrant visa with no annual cap and no lottery. It does not require employer sponsorship in the traditional sense and is available to self-employed individuals and business owners.
L-1 Intracompany Transfer
For Indian nationals who work for an Indian company with a U.S. affiliate, subsidiary, or parent. The L-1 allows transfer to the U.S. entity in a managerial, executive, or specialized knowledge role. The L-1A (for executives and managers) can support a green card through EB-1C without a priority date backlog — an important planning consideration for Indian nationals.
Dual Citizenship Strategy — Grenada CBI
Indian nationals who obtain citizenship in a treaty country through a citizenship-by-investment program become eligible for E-2 using their new passport. Grenada offers citizenship for approximately $235,000 (donation to the National Transformation Fund) with no residency requirement. After receiving Grenadian citizenship, the investor can apply for E-2 using their Grenada passport. Grenada has an E-2 treaty with the United States.
Portugal Golden Visa + E-2
Portuguese citizenship (obtainable through investment under Portugal's Golden Visa program) gives access to E-2 status as of March 2025, when Portugal was added to the E-2 treaty. This is a longer-term strategy but produces EU citizenship in addition to E-2 eligibility.
