The E-2 visa is only available to nationals of countries that have a qualifying Treaty of Commerce and Navigation with the United States. Iraq does not have such a treaty, which means Iraqi nationals are not eligible for E-2 status regardless of their investment amount or business qualifications. However, several strong alternative pathways exist.
Alternative U.S. investor visa pathways for Iraqi nationals
EB-5 Investor Visa
Open to all nationalities. Requires a substantial investment ($800,000–$1,050,000 in a Targeted Employment Area). Leads directly to a green card.
O-1 Visa — Extraordinary Ability
For individuals with extraordinary ability or achievement in business, science, arts, or athletics. No investment required.
L-1 Intracompany Transfer
Transfer from a foreign office or subsidiary to a U.S. branch. Requires an existing qualifying employer relationship.
Dual Citizenship Strategy
Obtain citizenship in a treaty country (such as Grenada via CBI for ~$235,000) and then apply for the E-2 visa using that passport.
