H-1B considerations for Chinese nationals

Chinese nationals face significant visa bulletin backlogs similar to India. EB-1A is often the most strategic green card option. China does not have an E-2 treaty with the U.S.

Eligibility requirements

  • Position must qualify as a 'specialty occupation' requiring at least a bachelor's degree in a specific field
  • Applicant must hold a U.S. bachelor's degree or foreign equivalent in the relevant field
  • A U.S. employer must sponsor the petition — self-employment is not permitted
  • Employer must file a Labor Condition Application (LCA) with the Department of Labor
  • Subject to an annual cap of 65,000 visas (plus 20,000 for U.S. master's degree holders)
  • Cap-exempt employers (universities, nonprofits affiliated with universities, government research organizations) can file year-round
